የአፍሪቃ መሪዎች ያለመከሰስ መብት


የአፍሪቃ መሪዎች ባለፈዉ ሳምንት ባካሄዱት ጉባኤ አንድ መሪ በስልጣን ላይ እያለ ክስ እንዳይመሠረትበት መስማማታቸዉ ትችት አስከትሏል። የአፍሪቃ የፍትህና የሰብዓዊ መብቶች ፍርድ ቤት የተሰኘዉ መድረክ ስልጣን ላይ የሚገኙ መሪዎችና ባለስልጣናትን መክሰስ እንዳይችል የታገደ ነዉ።

«የተደረገዉ ማሻሻያ አምነስቲ ኢንተርናሽናልን ያሳስበዋል፤ ምክንያቱም ለአፍሪቃ ሃገራት መሪዎች፣ የመንግስት ከፍተኛ ባልስልጣናትና መራሄ መንግስታት በጅምላ ጭፍጨፋ፣ በጦር ወንጀልና በሰብዓዊነት ላይ በሚፈፀሙ ወንጀሎች ያለመከሰስን ከለላ ይሰጣል። ያለመከሰስ መብት ደግሞ እንደሚታወቀዉ ወንጀል ፈፅሞ በነፃነት መንቀሳቀስን ያስከትላል። ይህም የሰብዓዊ መብት ጥሰት ሰለባዎችን ይጎዳል። ለዚህ ነዉ እኛ የተቃዉምነዉ።»
እንደአምነስቲ እምነትም ስልጣን ላይ የሚገኙት ፖለቲከኞች የማይከሰሱ ከሆነ የመብት ጥሰቶችና የጦር ወንጀሎች ቢፈፀሙም ተጠያቂዉ በነፃነት እንዲኖር ያስችላል። አፍሪቃ ለከፍተኛ የሰብዓዊ መብት ጥሰቶች ተጠያቂነት እንዲኖር ለማስቻል ጥረት እያደረገች በምትገኝበት በዚህ ወቅትም መሪዎቿ ይህንን ተግባራዊ ለማድረግ መስማማታቸዉ ትርጉም እንደሚያጣ ነዉ የተገለፀዉ። የአምነስቲ ኢንተርናሽናል የህግ አማካሪ ኮላዋሊ ኦላኒያ እንደሚሉት የአፍሪቃ መሪዎች ይህን ማሻሻያ ያደረጉበት ወቅት አነጋጋሪ ነዉ፤

«ይህ ነገር የመጣዉ የአፍሪቃ መሪዎች ዓለም ዓቀፉን የወንጀል ተመልካች ፍርድ ቤት ላይ ከፍተኛ ተቃዉሞ ባሰሙበት ወቅት ነዉ። ፖለቲካዊ ስሌት እንዳለዉ አናዉቅም። ነገር ግን ቀደም ብዬ እንዳልኩት ይህ ፍርድ ቤት የአፍሪቃ መሪዎች በስልጣን ላይ እስካሉና እስከቆዩ ድረስ ከሶ ከችሎት ማቆም አይችልም።»
የአፍሪቃ ኅብረት ICC በኬንያ ፕሬዝደንት ዑሁሩ ኬንያታና በምክትላቸዉ ላይ የመሠረተዉን ክስ እንዲያስነሳ የተመድ ላይ ያደረገዉ ግፊት ዉጤት አላመጣም። ሁለቱም በጎርጎሪዮሳዊዉ 2007ዓ,ም በሀገራቸዉ ከተካሄደዉ ምርጫ በኋላ በተፈጠረዉ ግጭት በሰብዓዊነት ላይ ከተፈፀሙ ወንጀሎች ጋ በተገናኘ ICC ክስ መስርቶባቸዋል።ሁለቱም ግን የቀረበባቸዉን ክስ ያስተባብላሉ። የአፍሪቃ መሪዎችም አፍሪቃ ላይ ብቻ ያተኩራል ያሉት ICC በመንበረ ስልጣናቸዉ ላይ የሚገኙ መሪዎች ላይ ክስ መመስረቱን በአንድ ድምፅ እየተቃወሙ ነዉ። ችሎቱ ከተመሠረተበት የሮማ ዉል ፈራሚ የአፍሪቃ ሃገራት ቦትስዋና ብቻ ይህን ተቃዉማለች።ተቺዎችም እንዲሁ የICC አባል ያልሆነችዉ ዩናይትድ ስቴትስ በአንድም ሆነ በሌላ መልኩ በፍርድ ቤቱ አሰራር እጇን እንደምትከት በማመልከት የአፍሪቃ መሪዎች በራሳቸዉ ላይ ያነጣጠረ ነዉ የሚሉትን ፍርድ ቤት አሠራር መቃወማቸዉ አይደንቅም ይላሉ። ኮላዋሊ ኦላኒያ በዚህ ላይ አስተያየታቸዉን እንዲሰጥተዋል፤

«እዉነታዉ አብዛኞቹ የአፍሪቃ መንግስታት ዓለም ዓቀፉ የወንጀል ችሎት የተመሠረተበት የሮም ዉል ፈራሚዎች ናቸዉ። እናም ይህን ተጠቅመዉ ለራሳቸዉ ያለመከሰስ መብት ማጎናጸም መሞከራቸዉ ስህተት ነዉ። ምክንያቱም ይህ ከመተዳደሪያ ደንባቸዉ የሚጻረር ነዉ። የኅብረቱን የመተዳደሪያ ደንቡን ብትመለከቺ የአፍሪቃ መንግስታት ወንጀል ፈጽሞ ሳይጠየቁ መኖርን ለመዋጋት ዝግጁና ፈቃደኛ ናቸዉ ይላል። ምክንያቱም ቀደም ብዬ እንዳልኩት ያለመከሰስ መብት መኖር ማለት ወንጀል ፈፅሞ በነፃ የመንቀሳቀስ መብት ያጎናፅፋል። ይህ ነዉ እየኛ አቋም፣ ለዚህም ነዉ የአፍሪቃ ኅብረትና የአፍሪቃ መሪዎች በዚህ ላይ ያደረጉትን ማሻሻያ እንዲያጤኑት የምንጠይቀዉ።»
አምነስቲ ኢንተርናሽናል የICC አካል ባለመሆኑ የክስ አቀራረብ ሂደትና አሠራሩን እንደማያዉቅ ያመለከቱት የድርጅቱ የሕግ አማካሪ ፍርድ ቤቱ ምንም ቢያደርግ በሰብዓዊነት ላይ ወንጀል የሚፈፅሙ መሪዎች ግን ስልጣን ላይ እስካሉ ድረስ አይከሰሱ የሚለዉን አጥብቆ እንደሚቃወም ገልጸዋል። ICC ከኬንያንያ መሪዎች በተጨማሪ በሱዳኑ ፕሬዝደንት ኦማር አልበሽር ላይ የቆረጠዉ የእስር ማዘዣ እስካሁን እልባት ያልተገኘለት መከራከሪያ እንደሆነ ነዉ።

MP Ana Gomes confirms that Yemen handed over Andargachew Tsige to Woyanne

In a letter to the U.K. Secretary of State for Foreign Affairs William Hague, European Member of Parliament Ana Gomes has said that Ato Andargachew Tsige has been handed over to the regime in Ethiopia. The following is the full text of Ana Gomes' letter:

Subject: Extradiction of Andargachew Tsege from Yemen to Ethiopia

Dear Mr. Hague, 

An Ethiopian activist who is currently based in London and is a holder of a British Passport has been detained in Sana’a onMonday, June 22nd. His name is Andargachew Tsege, he is a major Ethiopian opposition leader, and he was traveling from Dubai to Asmara, Eritreia, in Yemenia Airways which was transiting through Sana’a.

From the information I got, the Yemeni authorities have detained him at the airport and is whereabouts were unknown for days. I was informed that the British Embassy was aware of the detention and I believe that Yemeni authorities acted at the request of the Ethiopian authorities. Today, I have received information that Mr. Tsege was extradited to Ethiopia, which means that his life and physical integrity are in great danger and that he will be wrongfully accused of crimes he did not commit.

I am shocked with this blatant violation of the principle of non-refoulement by Yemeni authorities and seriously disappointed with the lack of visible action on the part of the British authorities, to secure the protection of Mr. Tsege.

I urge you, now, to do the utmost to ensure the release and the highest possible protection of Mr. Tsege in Ethiopia and his return to the United Kingdom as soon as possible.

Andargachew Tsige may already be in Addis Ababa

The British embassy in Yemen is unable to visit Ethiopian opposition leader Andargachew Tsige and Ethiopian Review sources in Addis Ababa are reporting that he has been sent to Addis Ababa over a week ago on June 22. The Yemeni secret police handed him over to the Woyanne junta agents within 72 hours after he was abducted while on a transit flight through Yemeni capital Sana'a, according to our sources. 

Ato Andargachew is a British citizen and has been traveling on British passport. The Yemeni government may have violated multiple international laws by detaining him from a transit flight and handing him over to the brutal dictatorship in Ethiopia where he is facing a death penalty.

Global Alliance Outraged by Mr. Andargachew Tsege’s Detention


Ethiopian-Americans are outraged by news of the illegal detention on June 23, 2014 of Mr. Andargachew Tsege, Secretary General of Ginbot 7, Movement for Justice, Freedom and Democracy while in transit at Sanaa International Airport in Yemen. Mr. Tsege was travelling with a United Kingdom passport at the time of his detention.Global alliance for the rights of Ethiopians
Mr. Tsege, a well-known pro-democracy and human rights activist in his ancestral homeland, Ethiopia, presents no threat to Yemen or to the Yemeni authorities. Mr. Tsege was imprisoned in Ethiopia for his political activities during the ill-fated election of 2005 and has escaped assassination attempts by the dictatorship in Ethiopia whose brutality, is well documented by international human rights groups and the United States State Department. He has been convicted and sentenced to death in absentia by the tyrannical regime in Ethiopia. We are particularly concerned that the continued illegal detention of Mr. Tsege, a renowned critic of the Ethiopian government is politically motivated and against international law.
It is now universally recognized that the Ethiopian regime subjects political opposition, human rights defenders, journalists and critics of the government in general, to persecution including threats, intimidation, arbitrary arrests and detentions, politically motivated trials, enforced disappearances and torture , extra-judicial killings.
Unconfirmed reports have come out from Ethiopia that the Ethiopian government has requested the extradition of Mr. Tsege to Ethiopia. The principle of non-refoulement is well established in customary international law, prohibiting states, in this case Yemen, from extraditing Mr.Tsege to Ethiopia where he will certainly face torture and even death by the brutal regime of Ethiopia.
It’s unconscionable that the Government of Yemen would hand Mr. Tsege over summarily to the security forces of the Ethiopian regime whose persecution of its critics at home and abroad is well documented.
We respectfully urge the Government of Yemen:
  • To release Mr. Tsege immediately and unconditionally;
  • To respect its solemn obligations under international law and release Mr Tesge immediately and unconditionally;
  • To immediately inform his family and loved ones of his whereabouts;
  • To allow ICRC representatives to visit him wherever he is being held;
  • To stop any illegal renditions the regime in Ethiopia may have requested.
We urge all human rights defenders and advocates to speak out against the illegal detention of Mr. Tsege and call on the government of Yemen for his unconditional and immediate release.

Reporters Without Borders condemns last week’s politically-motivated dismissal of 20 journalists

The 20 journalists were denied entry to ORTO headquarter on 25 June and were effectively dismissed without any explanations other than their alleged “narrow political views,” an assessment the management reached at the end of a workshop for journalists and regional government officials that included discussions on the controversial Master Plan of Addis that many activists believe is aimed at incorporating parts of Oromia into the federal city of Addis Ababa.
The journalists had reportedly expressed their disagreement with the violence used by the police in May to disperse student protests against the plan, resulting in many deaths.
It is not yet clear whether the journalists may also be subjected to other administrative or judicial proceedings.
“How can you fire journalists for their political views?” said Cléa Kahn-Sriber, the head of the Reporters Without Borders Africa desk. “The government must provide proper reasons for such a dismissal. Does it mean that Ethiopia has officially criminalized political opinion ?
In our view, this development must be seen as an attempt by the authorities to marginalize and supress all potential critiques ahead of the national elections scheduled for 2015 in Ethiopia. These journalists must be allowed to return to work and must not be subjected to any threats or obstruction.
Ethiopia is ranked 143rd out of 180 countries in the 2014 Reporters Without Borders press freedom index.

በዜጎቻችን ላይ እየደረሱ ለሚገኙት አሰቃቂ በደሎች በዋነኝነት ተጠያቂው የወያኔ መንግስት ቢሆንም፤ በስደት የሚኖሩ ዜጎቻችን ላይ ከወያኔ መንግስት ጋር በመተባበር በተደጋጋሚ አፈና እየፈፀሙና አጋልጠው እየሰጡ የሚገኙ የጎረቤት ሃገራት ወደፊት በኢትዮጵያ ህዝብና መንግስት ተጠያቂ እንደሚሆኑ ምንም ጥርጥር የለኝም። ነገር ግን ወገኖቼ ይህ አፈና እስከመቼ ይቀጥላል!? ዜጎች ጭቆናን በመቃወማቸው ብቻ በስደት ከሚደርስባቸው ስቃይ በላይ ለምን በየ ጎረቤት ሃገሩ ይታፈናሉ!? እኛ ኢትዮጵያውያን እስከመቼ እየተናቅን እንኖራለን!? ጎበዝ ዝምታውና መነጣጠሉ ይብቃ! የሚደርስብንን አፈና ለማስቆምና ራሳችንን ለመከላከል ሁላችንም በአንድነት ጫና መፍጠርና ማስገደድ ግድ ስለሚለን፤ በምንችለው ሁሉ መረባረብና መተባበር ይኖርብናል እላለሁ።
